View Full Version : I am a victim of assault, what happens now?

I was a victim of assault from a friend of mine who was later arrested and charged. I don't know what's going to happen next? If there is a trial, do I get a mail to my address? Is there a way I can drop the charges against the accused? Do I get the disclosure (the same one the offender gets?)

I live in Toronto, Ontario.

In many cases it's the local law officials who press the charges... and would have the right to drop them... not the individual... or the victim. Assault is a violation of the law and that's the basis of the charge if you want to prosecute it or not.

The Law enforcement officials really don't need your authorization or consent to proceed.

What happens next has everything to do with the prosecutor. SOME of them are very good at keeping the victim in the loop, and some aren't. If you want to be involved, I wouldn't leave it up to him to include you. YOU, however, can certainly keep in touch with his office, and I would.

Do you mean keep in touch with the prosecutor? I never got any information on about the case. They told me the suspect has been charged and is in the station. How do I find out who is my prosecutor? Do I have to wait for a mail regarding the case?

In the first court date, does the suspect have to plead guilty or not? (or is it the second court date?)

If you want to be kept in the loop, I would NOT wait. There is no absolute answer to your second question. It could happen at his first appearance or later, depending on lots of different things.

So what do you suggest? Do I go into the police station and ask about my case?? Need some advice on what to do. This incident just happened about a week or so ago.

Sure, that's a start.. Or you could CALL the prosecutors office and ask. They'll know...
