Hi,
I live in mississauga at present suffering from degenrating disk disease (neck and hand pain). I went to real superstore today to purchase my regular groceries. I put my stuffs in cart and just went out along with a trally to pickup a bag of salt. I cannot hold a bad and bring inside the store because of cronic pain of my hand, so I pull the trolly outside the store to get 2 bags of salt. I was thinking to get salt and pay everything inside store and leave from another door where I parked my car. Before taking the bas a security person came and he said you are under arrest for shoplifting case. I told him entire situation still he did not listen anything and he put me under 5000 shoplifting charge. He put a note in documentation whatever above described situation. He did not call police at that time but he said now police will call you please tell police about entire story. He said I cannot help you know because you made a mistake going out of store without pay. He said I understand you r inocent but I have to do my duty. I have all medical reports and x-ray, citiscan reports which proves that I cannot lift a 1 lb salt bag. While the bag was 10lb. I had too much pain at that time,
I don't know what's going to happen now? Police arrest me? Do I need tp pay lot of money? I am a well reputed person, IT manager. I donot have any criminal records like this never shoplifted.. I donot know why this happen to me? What should I do now?

Do NOTHING. If you hear from the cops, say NOTHING and hire a good criminal lawyer.

First do not return to that store, Second do what excon said. If the police do call, make an appointment to go to the station and bring your attorney with you.
Next time, before you exit the store, you approach a security person, manger or other store employee. Explain what you want to do and why before you leave the store with any unpaid merchandise.

I already meet a store manager and security and explain everything about the situation. I told them it was not my intense for shoplifting.I told them that You kept salt outside the store and it was my mistake I went out to bring salt bags with my cart. I had cronic pain in hand I could not lift salt bag and bring inside the store. They kept salt bags outside the main door superstore. Before I go to the salt bags security person catch me near by main entrance and said you are in fault. I already explain everything to security guy right a way and he put my comments that this person hand is week due to musle injusries. Not able to hold salt bangs and bring inside the store. Also he put a note that in such kind of situation person went out to get a salt with his cart from store without paying.. I am really sock and stressed. Unnecessarilly I have to spend money for court and police.
My question is a cop can understand the situation and get me out of this case? Police will call me 100%? Or they can drop the case without calling me?

They CAN drop the case without calling you, or they can investigate further. I don't know WHAT they're going to do. All I'm saying is IF they investigate further, the best thing for you to do is NOT TALK to them... Yes, a cop CAN understand what happened to you... But, that would only be IF a cop is INTERESTED in clearing your name... That isn't what cops DO. They bust people. IF their goal was to find out the TRUTH, I'd say you should talk to them.. But, that's NOT their goal.. Their goal is to ARREST somebody, and if they interview you, the person they want to arrest is YOU.

But that was AFTER the fact. The question is whether you can prove your story. The FACTS are that you left the store with unpaid merchandise.

Its not a cop's job to understand the situation. It's a cop's job to investigate the facts and determine if the facts show a crime was committed. Its then up to a prosecutor to determine whether there is a prosecutable case.
As excon said, we don't know what the cops will do in this situation. So you do NOTHING until you hear from the cops. If you do, then you do what I said, make an appointment to go to the station WITH an attorney.

I already talk to one lawyer. He said do not dicuss with cop Just tell him that I am not in fault and I will bring my lawyer.I donot receive any call from cop yet.
A cop could come to my home or work to arrest me too? I am a well reputed guy.. I never involved in such kind of cases. Is it make a sense I go to see a cop without receiveing any kind of call or later from them? Do I receive phone call or later?

NO! Its unlikely a cop will come to your home. There is no guarantee the store has even contacted the police so you do nothing. But in the event one does, you ask for permission to contact your attorney. Tell them you are willing to cooperate and answer questions as long as your attorney is present. If he refuses and takes you to the station you clam up and demand to have your attorney contacted. They will tell you all kind of things about how not talking makes you look guilty and stuff like that. You keep repeating the mantra; I am perfectly willing cooperate and answer questions as long as my attorney is present! Say nothing more than that.

1. cops can and are allowed to lie to you to get you to confess
2. cops want to find you guilty, and close a case, not to help you.
3. don't trust them if you are a suspect, they want to close a case and move to the next one.
4. don't tell them anything, even if they tell you that they will do nothing.
5 . Use the attorney.
*** for stores, Most know I am partically disabled, you tell one of the employees to get heavy things for you, you get the employees of the store carry you items out, if something is outside, you merely tell them at register what you want, and they get it for you.
