I was divorced in 2007 and as part of the divorce my ex-husband was to pay the mortgage and home equity loan associate with our marital home until the time the marital home was sold. It just sold in August of 2010 and he defaulted on both loans not paying either since Nov 2009. We entered into a short sale situation and as a result only $4,500 of the $50,000 Home Equity loan was satisfied. As a result, the bank is now suing both my ex-husband and I for the remaining amount. I have until Monday, November 29th to respond to the summons. I have no money and can not afford an attorney and I need to know how to respond to this summons to preserve my rights. Can anyone help with specific a way or example of how to respond? We both owe the money but are in a extremely difficult financial situation. He has not paid child support since Nov 2009 and I am close to now losing my own home as a result of his financial decisions. I need any kind of help someone is willing to give!
