View Full Version : How can I kick out my boyfriend being bailed out from jail?

I moved into his apartment Sep. last year. He got arrested beg of this year and now being bailed out staying with me.
Since he lost his job and no money in savings, I am paying rent and all bills including grocery. He has a car but can't afford so he is waiting for the car to be picked up. I never had friend or family who involved any kind of crime and my stress is max now. I need money for my daughter in college.
I have asked him to move out to his sister's place but he said it is not easy that he has to request an approval from the court. He is also mad at me He said he is not moving out.
Both of our name are on apartment contract paper. Is there any idea how I can make him move out from here? His sentencing court is over and he is waiting for the court instruction which prison he needs to go.
I really can't take this circumstance any more and want to have holiday season with my daughter comfortably.

You can't make him move. He has a right to stay there just like you do. You can SUE him for the money you're out, for all the good that's going to do.

You said you moved into HIS apartment. But that both names are on the lease. Was your name added as an occupant or a leasee? Because if you are not a leasee, then he can force you out, not the other way around. If you are both leasees, then you both have equal rights.

So if he is just awaiting assignment to prison, then wait it out and when the lease comes up for renewal, renew it in your name only.

The contract was renewed last month and I put my name on it. I guess I have to wait for court assignment...

You keep saying "contract"? While an apartment rental lease is a form of a contract, it is more correctly referred to as a lease. It most probably says Lease at the top of it. So by continuing to use the word contract, it makes me wonder.

Now you say this was renewed last month. Did you BOTH sign it or just you? If you read my previous response, this is a key point which you did not answer. If you want us to help it makes sense to read our responses and answer them fully.

And one last point, ANY question on law needs to include your general locale as laws vary by area.
