Can I suit a pain clinic for medical neglect? They continued to just keep giving my husband loads of pain pills. That's how all of these pain clinics are in FL. When will it stop? Florida physicians prescribe 5 times more meds than any other state. That's crazy! I don't feel he needs the pills. I know he was in a car accident but he doesn't need the high amount they keep giving him. Every month he gets 240 30mg blue roxys, 120 80mg oxycotins, and 60 2mg xanax bars.
You would think they would say, hey maybe you need to get surgery?

Discuss this with a medical malpractice lawyer. Medical malpractice is a complicated issue. As long as the caregiver did not ignore reasonable signs that would have indicated different treatment it may not be malpractice.

Assuming they are incorrect in their treatment, I fail to see damages. If he needs surgery, get surgery.
No harm, no foul.

What exactly is he taking the pain pills for? How many doctors has he consulted about the issue? What was the official diagnosis?
You may not feel that he "needs" the pills but what does your husband say about it? After all, he's the one who keeps getting the presciption refilled. Do you think he is addicted to them at this point?

That many pills means that he is possibly selling any excess pills or that he is hooked period. Either way if you want to make a real dent in this "pain clinic" contact the DEA and report this clinic as that many "pain meds" per month for one man far exceed the "legal limit" of what they should hand out each month. There would be no law suit here though, sorry. Just contact the DEA and they will happily audit the clinic's misuse of prescription medications they hand out. Possibly they may be shut down totally in the future due to this excessive abuse of writing prescriptions for pain meds.
I lived in Florida for many years and the reputable Board Certified doctors I went to for my legitimate pain meds flatly refused to prescribe excessive amounts of pain meds for me as they did not want to jeopardize their medical licenses or ruin my liver or kidneys. Obviously these folks at the "pain clinic" that you speak of are not reputable folks.
120 80mg oxycotins equates out to 4 pills a day with strength enough to make a person worse than "high". 20mg oxy is strong - but 80mg?
The DEA will be extremely interested in the 80mg Oxys being overprescribed...
