Normally not, without knowing what country you are in, and what exact local laws may apply.

And of course the issue of paying back the state for welfare that the custody parent or child may have had, can be done without support orders.

So there are so many what if, not given in the limited info.

But normally, in most areas, no the other parent can not get back support from the non custody parent if there was no previous support order.
