We are filing for bankruptcy because of an on the job injury resulting in a disability. We lost our Workmans Comp. case because of an automobile accident occurring before our case went to trial. There has been two trials with everyone pointing their finger at everyone else over the injury. We've lost everything and now live on my husbands disability insurance. With so little income and with having a complicated bankruptcy that we need to hire a lawyer for we are in danger of not being able to pay our Apt. rent. So my question is; can a person can be evicted while having an open bankruptcy in the state of Oregon?

Bankruptcy laws are Federal, with some items like exemptions based by state.

Yes you can be evicted for not paying your rent if you are in a bankruptcy, you can not include current rents in your plan.

But your attorney may be able to work something out for you, you need to talk to him.

Also you say your husbands disability, can you work?
