I was in a accident involving a car last year. I had no medical insurance and was paying monthly payments to many of the services that were provided to my in my emergency,(not wanting to ruin my good credit) while I was waiting for a 3rd party (car insurance of driver) to settle with me. I made arrangements with hospital for a settlement of 23,000 and ended up getting a settlement with the drivers car insurance for 50000 and they mailed a check from the 50000 for 23000 to hospital... now hospital is saying I need to pay the full amount of my bill. Stating they didn't not know I was receiving a settlement from ins. Can anyone give me any input as this doesn't not seem right to me. I don't see how I can sign a paper agreeing to a settlement with the hospital had the ins pay it and have them turn around and tell me I have to pay it all.

You only owe the hospital for the amount that you reached in settlement with them, I will assume that as standard practice you got that settlement in writing, they are bound by that amount they agreed to in writing with you,

Did the hospital know that you had a claim regarding the accident? Is the hospital claiming that you misled them in the settlement negotiations by failing to disclose the fact that you had a settlement due to you?

It sounds like you made a settlement with them based on your paying out of pocket. I would be surprised if you did not fill out a form in which you were asked whether the injuries were the result of an accident. And asked for the details of that accident. If you did not tell them that it was the result of a car accident and that you were pursuing a claim with the driver's insurance carrier, then you may have committed fraud. And, in that case, the settlement could be voided and they could ask for the full amount of the bill.

Originally I owed around 146000. They gave me a uninsured discount which brought it down to 30000 and had been 30000 for over a year. Then they sendt me to collections. Collector spoke other drivers car insurance and found out I could possibly be receiving a settlement for 50000. He state that they could only take 1/2 of my settlement by California law. So collector sent me a settlement for 1/2 my settlement which was 25000. At that point Hospital had taken back the acct from the collection agency. I had then followed up with hospital and made a settlement on the 30000 for 23000. I still had not signed off on any settlement with the drivers insurance as I was making sure that I would have enough settlement money to pay cal star life flight which is the remaining 27000 of settlement. Hospital agreed my 23000 and was then paid by drivers insurance. Now 2 months later hospital is asking for remaining balance of my settlement which is 27000

If the hospital was aware of the insurance claim and agreed to the settlement then they are out of luck.

Because I had made settlement with hospital before I had signed off on insurance settlement. Hospital said that I had to pay remaining balance of the 30000 which is 7500 ,which I received a bill for in oct 2010, once the insurance sent a check to the hospital, hospital said the only reason they agreed on the 23000 was because they thought I was paying out of pocket. As of today they are asking for the 27000.

Does anyone know if this is true?

It appears that you were truthful with the hospital. If so, I don't see how they could renege on their agreement with you.
