I have paid all the way through and had no inclin that he is not mine , my name is on birth certificate I have been lied to an am emotional an drained! need help or advice , is it illegal what she has done ? Do I have rights ? With thanks l. weller

I want to see my son , as much as I want , and do all the things I've been doing for him , the whole of the pregnency and for 6 weeks after I thought nothing untoward , until partner claims I'm not dad and another man is , it is cruel what I been through someone help!

If you signed the birth certificate or are listed as the father then you are the legal father until a court rules otherwise. However, the mother is in control here unless you go to court to enforce your rights. You have to go to court to get a visitation schedule ordered. She will then counter that you may not be the father in which case the court will order a paternity test.

Once the results of the test come back you go on from there.

What she has done is not illegal, unless she knew for a fact that you weren't the father. Then it could be considered fraud, but it would be hard to prove. It is, however unethical. If she knew there was a possibility you were not the father then, ethically, she should have informed both of the possibility each was the father.
