My husband was charge with impaired care & control + over legal limit. We paid x-coppers $4000 and they have represented him this far. Now the courts have said it will take at least 2 more court dates to resolve the case. The lawyer wants to charge $2000 per day. We won't qualify for legal aid because of my income even though I can barely support our family. My husband is a full time student since September 2009. His 3rd language is English. The prosecutor is unwilling to make a deal according to the lawyer. They have 2 witnesses but both witnesses have said nothing incriminating. The cops have directly lied on the stand, I can prove 1 lie directly through a phone bill. In fact, the cop that has been to court was not even the one that arrested my husband even though he says he is. He is a new cop and said the older cop wanted to give him experience coming to court. My husband blew over the legal limit. The accident was in Aug 2009, his first trial date was early Oct 2010 and now it has been postponed until Feb 2011. Isn't this way too long? He was never offered an interpreter even though the cop lied and said he did. My husband has an interpreter in the court room. We live in a smaller city and I keep hearing if this was Toronto it would have been thrown out already. How is this fair? There is way too much to say here. What should we do?

First no, court cases can take years, ( and years and years to keep going, if it was taking too long that is where your attorney has to file for a faster court dates.

And at least here in Atlanta the better DUI attorneys will get at least 10,000 just to start a case.

Next you are going to have to show that the amount that was blew was incorrect, and that they did not have a reason for the stop.

You did not show anything in your short writing that would throw it out.
And a officer lying, you prove that with written police reports
