View Full Version : If I am on felony probation can I leave New York state?

I an currently out of the county doing an intense outpatient, although my living arrangements are not stable or safe. My officer encourages me to stay where I am at but I don't have a place to live. I have been out of county for the last 7 months... for the most part doing well. No crimal charges and not dirty urins... just a lot of bouncing around. I have a sister if you will that lives in CT and I want to move there for a safe and stable place to live, and attend the intensive outpatient. Now I am able to be residing out of the county from my probation but would I be able to leave the state?

Only the permission of the PO you will have to request a transfer to the new state

Get the transfer BEFORE you leave the state for ANY reason or you will revoke your probation and end back in jail.

Depending on if your probation is supervised and unsupervised makes a big difference, if you are on supervised probation I would deffinately notify the probation office for your jurisdiction you were sentenced in, if you are on unsupervised probation, meaning you are not directly supervised by a probation office, you may move without notification, depending on the sanctions the judge may have placed, using all precautions I would ask the court or probation office in your jurisdiction
