View Full Version : Check forgery what can I do in this situation

My parents are not my guardians, but they receive my social security checks i.e. my mother is my 'payee.' I'm in the process of trying to be my own payee. I was receiving SSI and disability and then they uncovered that one of my parents had 'retirement funds' out for me... and so during the time I was receiving ssi and ss, I had an excess of 2000 in other funds. These funds were unknown to me and unavailable of course. When they found out, they stopped my SSI and my father then had to sell the retirement funds. The checks that he got were in my name and payable to me. Instead my mother took the checks, and deposited them in my social security bank account which "SHE" controls because she is the payee. The account has my name on it its ITF for me, but I have no access to it. My mother claimed that she would make sure that I wouldn't receive a DIME of that money according to her. It's my money and she controls it and worse.. she had to have forged the checks to have it deposited in that bank account. What can I do in this situation... call the bank? Call the police? I'm scared to go against my parents right now and am not looking to get them in trouble- yet... im trying to get access to money that is mine and on top of that my parents have done many things to me similar to this that are either illegal or fraudulent. I'm an adult... and I don't live with my parents, but live in a place they own so they feel they can do what they want to me even if its not legal... My mother insists the money is my father's since he created the funds but they are my funds and in my name... what can I do...

once ss found out as well, they claim they overpaid me for two years-- as a result I owed social security then 12,000... which again wasn't my fault. My parents told me that the office said to them they can't appeal it but they may be lying, so that they don't have to end up paying back the 12,000 and its on me. Worse, they took the retirement fund money, control it, and act as if they can spend it on random things... and have given no control to me and no access... yet they again deposited the checks that were made out to me, and in my name into that account for which I have no access...

You need to go in person down to your local Social Security Office and speak to them about ALL of this. We cannot help you here but they sure can help straighten this all out. If you are an adult and do not have a mental or emotional handicap you should be able to be your own payee and not your mother. It does not matter just who set this up for you but you need to straighten this out in person with the SS office. Do not tell your parents you are going to the SS office either as they will throw a fit. I have no idea why the SS office would claim you were overpaid. You need to inquire about that as well. Who told you? Your parents or did you actually see a letter that stated that information?

They are in control for some reason, you may need to get an attorney to represent you, not only against your parents, but also to protect you from SS.

... Social security claimed they overpaid me two years---because the entire time I've had SS--my dad has had these trust funds... just sitting out there.. because of those... I shouldn't even have been receiving SSI because you can't if you have assets over 2000 sitting around anywhere... of course I had no clue about those assets... my father did and I had and still have no access to them... regardless of SS... my mother took the trust fund checks that are in my name and deposited them in an account... and I didn't sign for them... ss did claim they overpaid me but that I could file an 'appeal'... then my mother claimed the lady said she can't appeal... and that I have to pay the money back...
