What can happen if you are on probation for 3 years and you have 2 months left to go and you get a violation?
You are on probation for a misdemeanor charge. You missed a date to see your probation officer. Will the judge lock you up? If so, for how long? And will your probation be reinstated to you ?
I need some advice. This is in the state of ny

Hello sex:

If you've been on probation for 34 months and all you did was miss one appointment, I can't even believe that your PO is violating you... They ARE pricks, aren't they? So, even if the PO does violate you, I can't believe the judge would put you in jail... It's ONE TECHNICAL violation, for crying out loud...

To get your answer you need to reread your original sentencing paperwork when the Judge put you on probation. You will see what the Judge had in mind should you violate your probation. He will be looking at this notation he made to himself when he sentenced you and going by that "notation" when you come before him at your VOP hearing. Could be jail. Don't know what you did to get on 3 years probation but I'm sure he had a reason to give you 3 years as he could have given you some jail time but decided to cut you a break at that time. Reinstated? It's up to him.
