Hello,

I own a small management company that manages a single family home in the District of Columbia. For the last few years, the renters have paid their rent on the 15th of each month as outlined in their lease agreement. The owner now wants to change their due date to the first of each month. As the management company (on behalf of the owner), we sent a letter to the tenants 45 days prior to the effective date of the change. The tenants sent back a letter that said that the lease is a binding document and cannot be unilaterilly amended. So they are refusing to comply with the change in the rent due date. Their lease will be up for renewal again in April. Is what they are saying true and we can't touch them until the next lease renewal? Thank you.

Yes. It's a BINDING agreement... You'd hold them to it if they violated it... Wouldn't you??

I don't see any sarcasm in Excon's initial response. He was simply pointing out the obvious.

If you want to change the payment date you are going to have to get their consent. Simple as that. In order to get their consent you probably need to offer them something. For example, if the next rent payment is now due on the 15th of November, tell them they don't have to pay it until December 1st (along with December's rent). It's a matter of negotiation. Give them something in return for their giving you something.
