I am in a perdicament I and my sister came to Georgia to help out a friend we are from Washington state it has been a living hell since being here but I can not move my sister is ill can he evict me I pay all the rent here and half the utilities I want to know what my rights are ? Can I stop paying rent there is no lease between he and I or my sister and he is subleasing with out the knowledge of his apartment landlord

Yes, your landlord (who is rentlng the premises from someone else and then sub-letting it to you and your sister) can evict you. Why does he want to?

We clash as room mates I don't think that's fair I traveled all they way across the dang country to help this person so he wouldn't lose his apartment and I am going to be the one assed out he better be glad I am not a spitefull person both my sis and I are disabled sure its his place on paper but we been paying the full 605 rent for the last 5 months I should have known better I guess

I'm sorry, but you have been real unclear as to what the situation is. So you're saying that he has a lease and in turn is sub-renting to you and your sister so that the three of you share the premises? Do you have anything in writing?

Yes he has a lease with the apartment he called me in Washington state and said he lost his job and needed help could I come help him so I did I have no lease with him or with the apartment my sis and I havepaid the full rent for 5 months

If you had no lease in writing... you are considered month to month... and he only needs to give you 30 days notice. You may have to prove you paid in advance that far... in case he isn't so quick to return the unused amount of the rent.

It doesn't matter that you paid the rent. You area his month to month tenant and he can terminate your tenancy on 30 days notice.
I hate to say this but next time you need to choose your friends more wisely.

Agreed, sorry, but yes, he can merely give you notice to move out. *** I would assume he has a plan to pay the rent now, if he kicks you out ?
But you are already paying his rent, so just go out and find your own place to rent

Easier said then done I don't make 3 times the amount of rent here in Georgia and I don't have enough saved to go home so I am stuck great friend I had not!!
