View Full Version : My job Vs. My health(fully detailed)

I have been working for this store for three years now. After my first year and a half I transferred within the company to one of their newer store closer to home. I was there for two months and went back to my old store. During my first year, I worked a department and rancid animal food fell all on my clothes; the following day I woke up sick, nauseated, and my chest was broken out from where it fell on. The whole store knew what happened. I got placed in that department and became very nauseated again and started sneezing and cough. There is major dust in that department from stuff that sits on the shelf for long periods. We have to bring forward the items on the shelf so it looks like nobody shopped it. I told them how I feel about the department and haven't been placed there since.
I also have a high allergy to fragerances. So this department, I can work around (meaning two aisles before and two aisles after) a particular section in this department because of the mixture of scents from the fabric softners and fabric softners sheets. I have expressed this concern with a past manager and she expressed it with the other managers and therefore have not been placed in that department either. Now,during the two months I was gone the store gained a new HR Rep and a new Store Manager.
Everything was perfectly fine between myself and the managers (no personal perfrence, just connecting as a team). As time went on, I gained experience in working with other teams at the store: price accuracy, guest services, backroom( I am even certified to pull items off the shelf and sell them, like inventory tracking). The store needed help in another department and I had been there every since until the passing of my father, this past March. Because the Coporation changed it's systems, the new team I was own, everybody had to be re-interviewed to keep their position in that department (this was in February). I did the interview and 3 weeks later my father passed. I was gone from the 4th of march and due to return to work on the 21st. But on the 19th, I was ended up have surgery and was out an additional two weeks. I returned to work April 12th.
When I returned to work, I had restrictions, but I was doing team lead work which required me bending lifting semi-heavy things, pushing tubs (metal crates that product sits on that needs to be put on the floor (shelves).), and maintaining the department to look good. This was all done until the team lead for the department returned from her LOA. At this point I thought I was goingto be placed back in the department I had interviewed for, but I haven't. I am only there to cover someone's shift, this team gets an additional fifty cent pay. The times I have worked in the department on shift, I have not gotten that fifty cent increase for those days.
Now for the harse stuff. I have had a problem with a team lead that, as of October 18th, 2010, she no longer works here. One night, I was placed in a department that nobody in the store likes working. I was upset but I still managed to get the job half way done as the manager told me to do. The team lead came by and asked how I was doing and I told her fine. I expected her to leave me alone as I continued to do my job. She kept talking to me to a point I got annoyed and told she was annoying me and I would like to be left alone. I told the store manager what happened and found out my words were twisted. I spoke to my HR personal and she stated that I was in the wrong and we would talk with the team lead later in the week when she was working ( that never happened).
During those weeks, the manager that was on duty that night started treating me differently like I pissed her off or something, then the team lead started to question me whenever she saw in the front of the store ( I could be coming out of the bathroom, coming from my locker, clocking in for or out from work, helping at guest services, or on my non-paid or paid breaks). The final straw was when she apporached me on my break and I blurted " Excuse me" four times before saying I had two minutes left on my break. She later checked the cameras and calledme into the office. She accused me of taking a longer break than I stated. I told her "not to be mean but because our personalities clash and I truely don't like you, you are, from now to have a manager with you when you need to speak with me, because you are speak to me in a manner I don't appreciate and I truely feel like your doing to get underneath my skin." She smirled and continued to talk, I told her I was going back to my department and that was that.
I spoke to my HR personal again and I told her the team lead is not to speak to me or question me at all, unless she stops by the department I am working and ask me. Hr stated she is a team lead and that's that. After that day, the same manger started putting me in the departments mentioned earlier. I was told by the HR personal to havea doctors note stated I could not work around departments I have allergies in( all of a sudden I am required to have a doctors note. Funny thing was the team lead use to work in the HR department and she told me even if you have a doctors's note its proof of your word and won't cover an absence or illness, no matter what the case is. Meaning if I had one the managers could still place me in those departments).
Because I don't have a primary doctor, I can't get a doctor's note without seeing the doctor first, but lately I have had no need for a doctor because I am taking care of myself naturally, even going to work sick and coming home drowning myself in clothes and a heater. The manager that had a personal perfernce thing with the team lead had asked me to work in the department that has the fragences, I told her sure I'll do it but I cannot do the specific aisles she requested to have me pay attention too. The manager stood there and asked me if I wanted to switch with another worker in a different department, I told her it's her decision and that I could do that department but not those aisles. She called me into the office of the HR personal(she was there too) to discuss that fact I refused to do what she me asked me to do. I just sat there in so much pain because I was disgusted that she lied to the HR personal. The Hr rep told me because I don't have a doctor's notes, I will be taken off the floor and placed as a cashier. I have been cashier for three weeks now on and off because I get placed on the floor here and there, until new employees are hired and then I'm stuck cashiering. Just recently, I had a customer purchase four boxes of the fabric softerner sheets ( I could smell them before she even placed them on the belt to be rang up), when she saw me holding my breathe, she asked why I was ringing up the fabric softner sheets first. I told because I have an allergy and the scent causes me to feel very sick, she took one of the boxes out the bag and stated but they smell so good and squeezed the box mear my face. I stepped back and called my cashier team lead to take over my lane because I began to feel sick and dizzy. Today, I am trying to figure out what to do because in order for me to get the doctors note I have to fake an illness just to get into the office or I'm stuck with waiting two weeks and who knows what my schedule will be in November since only the managers and team leads can go on vacations and not the lower half of the staff. I am more exposed to having allergy issues as a cashier than being on the floor, what do I do?

It's a little TOO detailed. I didn't read the whole thing because MOST of it doesn't matter. I'm not even sure what you want.

Do you want to take time off to heal yourself?? Do you want a different job within the company? The Family and Medical Leave Act (http://www.dol.gov/whd/fmla/index.htm) should help you with your sick time off. But, I can't help you with company politics. Legally, they can do with you as they please.

LOL! Well every since I started having a problem with the team lead it's starting to feel like they don't want me there anymore. I started to here rumors and they won't even tell me the truth.
