So in February my fiancé and I moved 8 hours away from our friends and family to start a life of our own, and then we broke up about a month ago. His credit sucks, so my name is on all the bills but he does pay half, or at least he was until last week when he failed to give me his half of the electric and car insurance. I turned in my papers for an early termination of my lease, which is in 4 weeks now, but it's too long. Twice now we have gotten in fights where I ended up with bruises from him, although I did get right back in his face.
I'm aware of the 30 day eviction notice even if his name is not on the lease, but I don't know what to do. I'm afraid to come home if he's here because I never know if we're going to get into a fight. Just tonight he woke me up by throwing stuff at me to ask where his pots and pans are (they are put away because he never cleans them and we get bugs). When I didn't tell him he threatened to take my car for a joy ride. I guess he didn't want to get arrested for car theft though because he took his truck. I told him I would give him the cooking stuff if he was actually going to clean them (I would think that's a perfectly reasonable request).
Well that's the story. My question is do I have any legal rights to get his half of the bills since his name isn't on the lease? It would include half of the early termination fee for the lease, half the electric, and half the car insurance.
Also is there anything I can do for the next 4 weeks to get him to leave me alone?! Getting a restraining order seems so drastic but I might have to if we get into another fight. But I can't kick him out since he does get his mail here.
If I can't get my half of the money (I will agree I was a big idiot moving here with him and taking his word he would not screw me over) I would at least like peace. I don't know what to do.
