The bottom line is that his parents are against it. He is 13 (a minor) living under their rules.
I would leave him alone.

Depending upon which state you are in, you kissing and holding hands with a minor child, could indeed be actionable by his parents via the police.
It makes no difference whether you are male or female, or whether his parents are homophobic, but he is a minor, and as such, his parents do have control over his relationship with you. A 13 year old girl dating a 16 year old boy would have the same consequence, and the parents would still be in charge.
I agree with Enigma. You continuing to see this minor, is asking for trouble by the sounds of things.

You are going to have to wait till he is 18, and he is making decisions for himself, because while under the rule of his parents, he has to abide by their laws, and although it is unfair that is the way it is.
Good Luck,
