View Full Version : How successful are motions to set aside for criminal felonies in Arizona

I was convicted of a C6 undesignated Felony in 1999 and in 2004 I went back to court and had it reduced to a misdemeanor. During that time I was on probation. Since 1994 I have lost my job and can not get work because of the probation. Is it worth it to file a motion to set aside in Arizona or would I be wasting my time?

If they were able to get a charge that was already convicted change, they may have a magic touch, ( would like to hear how that was done)

But you have little or nothing to lose if you want to try

They're not going to set your conviction aside. What would be THEIR reason. They have NO incentive to do so, and every reason NOT to do so. You're better off applying for expungement or a pardon..

What is the difference between a set aside and an expungement procedurally speaking. I have been out of work for the last 18 months and had two offers that were rescinded after they did a background check. I can't support my family and it seems that the court would want me to be a contributing member of society. I am not asking for lienency I just want my records sealed so that I don't have to reveal my conviction back in '99 and probation till '04. What can I do to get that?

I just googled expungement in Arizona. I came up with THIS (http://www.arizona-expungement.com/)website. It says that Arizona calls expungement "set aside", so I owe you an apology.

You're going to need a lawyer, and I don't recommend THIS site because I know nothing about them.
