Out of a group of employees at a particular that has a team of 3 members which all three have attandance issues, communication issues and problems completing tasks per deadline date but only one of them is singled out and written up and give a 30 day evaluation with corrective actions to follow. What do you think? Is this discrimination of some sort?

Is this discrimination of some sort?Hello L:
It IS. But, there's no protected class of people called the WRONGLY ACCUSED. Therefore, this kind of discrimination IS legal.

There are all sorts of discrimination, but only a small amount is illegal. I could go into my office and fire every red haired clerk. Nothing illegal, since having red hair is not a protected class. I could go in and fire anyone that is not related to me, giving family more rights is bad but not illegal.
So was this one picked out because they were a different race, or a different religion, were they picked out of the group because they are gay
If they were picked out to get a warning because of some protected class issue, then it is illegal,
If not, most likely discrimination but not an illegal one
