My name only is on the mortgage. On the deed there is my name, and my partner's name. Can I sell the house without his agreement?

No. If your partner's name is on the deed then they are an owner and the house cannot be sold without the signatures of all owners.

You have to have your name on it for starters... you may have been responsible for the mortgage... but when the sale occurs... your name isn't associated with it. I'd get that corrected. Technically YOU can't sell anything... only your partner can. Only people who's name is on the deed can do so... or entities with legal status to operate on their behalf.

To be clearer - my name is on the mortgage AND on the deed. My partner's name is on the deed only. We live in the house for 3 years now. If we are to sell the house, what is good time to sell it... I heard that there are profit penalties if the house is sold before some period passes
