View Full Version : Can a owner evict a disabled Sec 8 tenant without cause?

I am disabled on Section 8, and the owner has become non-coorperative. Can I be evicted without cause? The owner won't make needed repairs to the apartment. Has consistently complained that HUD will not increase payments, and that I have to go.

The fact that you're disabled and on Section 8 doesn't matter. What's in your LEASE matters. If you don't have one, you're a month to month tenant, and can be asked to vacate with 30 days written notice, depending on where you live.

Have you contacted the Section 8 HUD people to see what they have to say about this do nothing landlord? They have certain critria that the landlord MUST follow in order to retain the government hand out rental monies to them. If he does not adhere to the fix up the place clause then he will lose his Section 8 designation on his rental premises. Maybe he wants it that way so he doesn't have to cowtow to the government any longer and make more bucks each month.

I hope you are on a waiting list for public housing. Private landlords who take Section 8 often balk at doing repairs because the rent reimbursement is so low. Contact whatever agency is available to you locally for housing help.

Of course one of the reasons I won't rent any of my properties though section 8 is that they require many standards, so if your property is not being keep up to codes file a complaint with the section 8 manager.
Unless you have a lease they can file in most areas for you to be evicted, the court may give you some additional time but that is about it
