There are 2 people that are suppose to be in the US but they are in Mexico. They only come when they need to come to the US. They enter from Tijuana so that the US government won't notice they come in and out. What's the use of being legal in the US and not being here? There's other people that would love to be here legally and they are in Mexico. Tax season they come to do taxes and they don't even work in the US. What can be done in this case?

If they are legally able to be in the US why are they not able to do so?

Many people, from a variety of countries, would like to be in the US legally, but they do not meet the requirements to do so. Every country has set ways of entering and remaining in that country legally. If someone can't, then they can't. It would be nice if people could up and move to any country of their choosing, but it doesn't work that way.

Please provide more details to the situation.

US Citizens aren't SUPPOSED to BE anyplace. This is a free country, and our citizens can go anywhere they like.

I undertand that it is a free country. But there are people that became residents of the US for a reason and now they live in Mexico and they just come to the US when it's tax season to do them. Shouldn't there be a penalty for these people? From what I was told by them they had to come live out here in the US because the government was going to take there residency away if they didn't come and show proof of them living in the US. That what was the point on obtaining residency and they are not living here?

No, you don't. Otherwise you wouldn't think there should be a penalty for what they're doing. They're FREE. They can live in Mexico.

They are from Mexico and they came to the US to get legal and then they went back. Why would they want to be legal in the US and not live here in the US? They only come when it's tax season to do taxes and they come in through Tijuana so that the government don't notice that they are not here in the US.

I have no idea WHY they're doing what they're doing... All I know is it's perfectly LEGAL.

By the way, even though they come through Tijuana, they go through customs just like they would at any port of entry. So, the US government knows exactly when they come and when they go. But, they don't care, because they're not breaking any laws.

And keep in mind that they are not citizens they just became residents and they don't live in the US. What's the point of becoming a resident and not live in the US?

Perhaps they have family in Mexico. Maybe they just like living in Mexico. By becoming legal residents in the US they are able to legally work in the US.

They live in Mexico all year long. It's just a waste of residency!! Don't you think?

As long as they return within the time limits and, if necessary, obtain a re-entry permit, and pay their taxes they can live where they choose to.

There are requirements they have to meet to maintain their residency, so they would be wise to make sure they follow these exactly if they don't want to lose their resident status.

They may have family there... why wouldn't they want to be with their family if they can do so? It beats trying to work illegally in the US... at least they followed the requirements and hopefully they will continue to do so.
