View Full Version : If I have P.O.A. Over my parents can I sign a Quit Claim Deed to myself as P.O.A.

I have P.O.A. over my parents and they are trying to keep Jr. from trying to claim their land because he has the same name as my dad so they want to Quit Claim Deed it to me so that I can sell the land for them without Jr. interferring. Can I sign for dad because he has dementia even though the land is being deeded over to me?

I would do nothing along these lines without consulting with an Attorney - in NY you CANNOT use the P/A to enrich yourself and I am not sure where you are nor am I positive how this transaction would be viewed if there were a legal action.

How has Junior been trying to claim their land & interfering with their title to the land? I find it hard that similar names would confuse adult professionals in the real world (as opposed to comedy on the stage or screen).

Names are the same Ervin Joseph LaMie Jr. & Sr.My dad never put Sr. on anything.In 08 when I tried to get Guard & Consv. Over my parents Jr. took over the courtroom (the judge let him as still is after over 2 1/2 years.

Dad was in the nursing home & Jr. got a loan for $500,000 on his home in dads name because is was in foreclosure and he stole dads social security card and still has it and is still using it.

The judge gave Jr. a FEDERAL FELON Conservatorship (while Jr. was sitting in jail for B & E of his ex-wifes home) over them & Jr. stole all of their savings.

Now we are afraid that Jr.is going to make another fake Q.C.D. on the farm so mom wants me to take the land over before dad dies so that Jr. can get away with the land on top of everything.

This would be funny if it was onscreen,but Jr. has taken everything from my parents got their house condemned etc. and it has to stop.The judge and lawyers and Prosecuting Attorney are letting him get away with everything.

As JudyKT said, conveying the property to yourself would not be a good idea. Get an attorney to advise you, but what you might consider doing is setting up a trust instead, with your parents as beneficiaries and yourself as trustee.
