Hi I have a 5 month old daughter who mt Fiancé want to adopt. The problem is her bio dad pretty much has nuthing to do with her he never responds to me when I call or text and he never asks about her at all. Its been like this for 3 months and I was wondering how long he has to go without having anything to do with her before I can file for abandonment and get his rights terminated so my fiancé can adopt her

18 years or so, it does not work that way. You will have to get him to sign over his rights,
Have you been to court and got court ordered child support ? If no, he does not even owe anything yet.

I agree, not having anything to do with her does not constitute abandonment. She is in your care, so he can't abandon what he is not in charge of caring for.

First, this is a legal question so has been moved from the Children forum. Please be more careful in choosing a forum to post in in the future.

If your fiancée wants to adopt, then hire a family law attorney who can advise you on what to do. In most areas you will need to be married first. In all areas you will need to get the bio father to approve the adoption or convince the court to terminate his rights. An attorney can tell you all that.
