My ex will try and fight me for him because he has a lot more money. My ex did not give me any time to look for a place for me and the baby. He is hardly ever home so he never really sees his son and when he is home all he does is play his xbox. I finally found a 2 bedroom apartment and I'm starting school next month. I know he loves his son but, if I have to leave him alone with his father I stress a lot because he doesn't watch him.

If you mean full custody WITHOUT visitation from his dad, your chances are ZERO.

If he's a danger to your son, the court can order SUPERVISED visits until he learns to be a fit parent. But, you're going to have to PROVE he's unfit. You can't just say it.

As excon has already noted, if you want sole custody of the child, you need to prove that the father is a danger to him.
Of course he's been going out and partying until 5am - you're watching the baby. There has been nothing requiring him to stay at home.
If he's been this uninvolved when the child is living at home, I'm sure he'll continue that pattern even if you move and he is given visitation rights.
