"I have foster baby in az. got her when she was 1 month old she is now 11 months. suddenly a relative, paternal aunt, has come forward to ask for custody. does she have more rights than us? will the court view as her best interest to be with aunt? " Prior to now the attorney at litem was recommending adoption in our home. The mother who has her rights wants us to adopt. Father is in prison for 10 years.

I think no one can give you straight answer. Az law and court practice are inconsistent.Sorry if it is not the answer you would like to hear.

This one will be up to the courts. But a foster parent is a temporary guardian. In general, a blood relative would have greater rights. But if you had applied for adoption, and the mother was supporting the court may award you adoption. The only thing you can do is let it play out in the courts.
