View Full Version : Can a two time covicted felon be granted custody?

My soon to be ex-husband, is a two time convicted felon for robbery, and forgery. He can't keep a job, (while we were together I worked) and he disappears whenever things get to hard for him or when he thinks he can get some money out of a friend or family member, he's constantly homeless, but he thinks that he is the best caregiver for our children. In fact recently, when I let him see them for two days he found himself a ride out of the state with our children and I haven't seen them in four weeks. On top of all that he has done after we were separated, while we were together, he used to be violent in front of the children didn't take care of the home, it was not a place I liked my children to be, and he used to beat me in front of them. He treated all of us horribly, and I left to save my life and later came back for my children, only to lose them again to him because he can't even visit them without acting like a criminal. Do I have a good chance for custody?

Yes, according to what you say. I suspect, however, that his version might emphisize different facts.

Yes, a convicted felon can be awarded custody if, considering all the circumstances, it would be in the best interest of the child.

Can a ex felon, get custody, yes happens all the time,

In court what you will have to do, is prove he has abused you, what evidence is there, police reports, Hospital reports ? Are the children old enough to testify in court about what they say??

His not having a stable home can effect it , but is not the major factor.

You will have to prove to the court the children will be better with you.

Court will take him down get yourself a good solicitor and ull get your kids bk he's got them in danger really you could go on that grounds hope all goes well keep me up t date about what happens goodluck also if court says about having an agreement between uz both settled out th court take it but know where you fae so don't know if laws different as am from scotland xx
