I have been charged over $250 over the course of a few weeks in overdraft fees. I thought that it was kind of weird how they juggled my balance. It always seemed that they put the higher transactions first and then the least amount. Some things would disappear and not show and then they would be pending. It has caused me to not be able to buy food for my family and the stress on my kids has been awful. I know that they are unfairly doing this. I even noticed that they charged me $5 more for a check that I wrote. They credited me back but it seems a little sketchy to me. I made a deposit on a Thursday and it cleared the next day and then it disappeared from my checking and caused my account to overdraw again. Is it possible to sue them for this?

This seems like pretty unfair practices. Have you tried talking to them first. In many instances they will waive the fees for customers in good standing. I am not sure about the legal path but I would imagine that's a lot more complicated and involved. Try talking to the bank first before litigation.

I did speak with them and they were not willing to help at all. They were so nasty to me. I guess that I will just have to close my account. Thanks for replying.

When you deposit a check into your account it takes more than a day before you can spend that money, the check could bounce or a stop payment could have been issued. Set up a meeting with the branch manger and ask him to review your account with you to see what has happened.

Yes, most of the larger banks, do clear the larger checks first and then the smaller checks each night when they do the balance. Also they charge all the checks prior to applying any deposits.

Also The deposit merely showing up online does not mean the money is available. It merely means it was made, bu can take two or three days to be cleared for funds to be used against payments.
