This is a legal question - the Court will examine ALL assets and factors and make a determination.

You need an Attorney before you make any move.

Moved to family law area.

First who says someone has to pay, if no one files and asks for it, there is none to pay. And in court if you or the other party asks for it, it can be decided though mediation or fought out in court as to income each brought into the marriage, earnings during marriage and other property division at divorce.

So if you both agree to just divorce, use the same attorney to fill out divorce papers and agree on all property division, it goes real easy

OP is on disability and wife has superior income - from what I can read the Court does not want him to go on public assistance and will address the support issue.

I don't think there has to be a separate request. It's part of the divorce/property settlement agreement and I don't believe the Court will allow anyone to surrender his/her right to be supported.

Of course, I've been wrong before...
