I was sub-renting a garage from a friend while we were visiting with another friend in my garage the police knocked they wanted to question my friend about another friends car that was reported stolen while they were there one of the officers opens a box that I had some digital scales with smale zip lock baggies in it.They asked,"wheres the drugs?" then they find a bag of suspected meth outside of the garage in a public alley.my friend who I was renting the garage from has a very old conviction for possession of a controlled substance for sales so they assumed that the dugs and the scale was his .I told the officers three times that the scales were mine.one officer asked me,"what was i doing trying to gat a charge?" I said no and then shut up.they never arrested me but now my friend is fighting a new case with priors.he would be elligable for prop36 if it was just possession but because of my scales and baggies he's looking at doing a lot of time for sales.so my question is if I was to go to court and claime the scales would it make a difference at all?or would he most likely still be stuck with sales?also would they be able to file charges on me by going to court for him and admitting to the scales being mine?
