View Full Version : Reporting someone to the dept of labor and immigration?

My husband is here illegally but has been here for 8 years and has not been in any kind of criminal trouble. He also has a full time job and I am pregnant. He worked on a friends car 3 months ago. Well she decides to tetx me now, knowing that I just got money from school and is telling me that he took her money for parts and labor but did not really replace anything. She said that if he doesn't give her back her money she is going to report him to the dept of labor and immigration. I watched him fix her car and he kept the reciecpts for all the parts. What would you do in a situation like this?

Get a lawyer to draft a letter to them with copies of the reciepts as proof (keep the originals where you won't lose them)
I had a similar situation years ago where I actually had a signed contract for the work as well.
What they are trying to do constitutes fraud.
Did they write a check or pay cash? I'm willing to bet this was a cash transaction they can't prove.
After all, the Burden of proof is on them if such a suit would ever be filed. Keep the original reciets and any other information you have about the situation in case you need them. Don't even talk to them on the phone or face to face. THey will likely be fishing for information to use against you. Or be recording the conversations.
Don't contact them yourself... let the lawyer do it. Its only a few hundred depending on the rates in your area... and distance yourself from this "Friend". With friends like that who needs enemies.
However this is really isn't about immigration law. But Cilil law and possibily Small Claims.
None of this would prevent them from contacting the INS, if you pay them or not.
