View Full Version : Will my boyfriend serve jail time for interference w/ govt property? Please

He was drunk and arrested for disorderly conduct in South Georgia. While in police car he began kicking the window. He bent the frame and caused over $1000 in damages. The local court sent it to Superior court. Two years later, still on bond, Superior court has opened his case and indicted him on TWO felonies. The origianl DConduct was dismissed and they added a felony of Criminal damage to property 2nd degree to the already charge of Interference with govt property 1st degree. He has had 2 calendar calls and now has Pretrial on Tuesday. I have tried to get him to obtain a lawyer and he just put it off. Now he wants to get it postponed.. I don't know how that will happen. The story just gets deeper... I just need some help to ease my mind. I don't know what to expect in court (which is in 2 days)

If you're with a guy who doesn't want to help himself, there's NOTHING you can do - except watch him destroy himself... Bummer for you.
Now, I don't know the details, and that's WHERE the judge will get HIS information, but if this is his first offense, with the proper legal defense, he SHOULD get probation... But, the prosecutor is going to want to throw him in the slam, and without a rigorous defense, the prosecutor is going to win.

He was pulled over and the warrant came up, the county didn't want to pick him up because of distance. He plans to walk into court and just plea guilty. He believes he will only get a fine.

If you want to add more info, ANSWER the question yourself, this puts it in a new large box, most people will never read the comments you give others.
So merely answer your own queston to add more info please.
Next, small town south Georgia, have to say it can be corrupt and at times really the version of the south you see on TV. Hopefully this is in Savanah which is a larger city and not as much of the home grown polictical system as in other smaller towns in south GA.
A couple of things, since this and his arrest, the probation issue and that warrant will come into play. I can not see how they will not have to hold him on that now.
Next if he merely walks in and pleads guilty I would guess that yes he will get some jail time, most likely 1 year or less. Prison is the major industry in GA, but lucky at this point they are full, but also this was an abuse and problem against the police ( their car) which will not be taken lightly, had it been your car or my car, I would say he may walk on a new probation, but not with a police car.
Next has he the money the day of the court to pay for all the damages, that will help.

I would expect, jail 6 months to one year , and a large fine, and to pay all the damges. But that is my guess.

You are actually the person I wanted to hear from.. I am new at this.
Incident occurred in Tybee Island and was sent from that Judge to Superior Court (with Judge Brennan). I have told him about the money for fines for MONTHS and he don't care
