View Full Version : What are the chances I don't get jail time for a vop?

I was arrested for a 2nd dui while on probation. I am a decorated marine with 5 combat tours and a great job, does that carry any weight on my hearing? What are the possibilites i get other punishment other than jail ?

2nd offence for a DUI? Bad news, many places are throwing the book at repeat offenders with the rash of high profile traffic deaths as a result of drunk drivers. I have a neighbor that's doing a year in jail for a DUI, was his third I think.

Your actual Blood alcohol index might help or hinder any chances you have.

First you may have jail time from just the DUI, many states have required jail time just for that.

And of course the court may throw the book more at you, since a Marine of HONOR should have more respect for the law and esp for the safety of others.

I, as well, thank you for your service. But your time served has nothing to do with your DUIs and subsequent convictions.

You drank... you drove... you got caught, times 2. After the first time you knew it was wrong, so why do it again?

Actually, as a decorated Marine and as a war hero you should have known this was wrong and illegal. Why do it a second time?

This nation's children look up to men like you and look how you damaged your reputation. Not once but twice. Is this what you want the future war heroes to think is okay?

Two of my sons are also decorated and have recently returned home. If you want to help yourself I suggest you get into treatment prior to court. Show the court that you know you have a problem and are willing to do something about it.

My late husband had a severe drinking problem as a Viet Nam vet and a decorated SF Green Beret. He had a lot of problems just dealing with his memories especially at night before bedtime. I can well relate to your "problems" and why you drink. He only would drink at home and never drive as he had gotten one DUI and had community service and a huge fine to deal with. He never stopped drinking but he DID stop drinking and driving.

You need to seriously rethink your dependence on alcohol and hopefully get into a program and quit.

I hope you have a very understanding Judge who just might cut you a break this time and not actually give you jail time. It's going to be a close call if you do some jail time or not. Maybe 30 days tops.

I personally thank you for your service as well.
