Can a married man have a kid from his girl friend ! Regardless of you think this is cheating or not. Dr. Phil who is pretending to be an ideal and like an angel admitted he did and many times. I'm asking from the legal point of view

I don't really understand your question.
Why is this in family law? What kind of legal advice are you looking for?
Yes, a man can get another woman pregnant and have a child with her. He would then be responsible for paying for the care of that child, even if he chooses not to be in the child's life.
As for Dr.Phil, where did you get your info from? As far as I know he only has children with his wife Robin. I'd love to see your source of information and it better not be a tabloid magazine.

Biologically, yes. One can beget children from persons other than one's spouse.
And legally, yes. They would be his children, albeit not legitimate.

Is it legal to have a kid from an affair if you are married? And the kid can carry your name?

You aren't going to jail or receive a fine, if that's what you mean.
Legitimacy was formerly of great consequence, in that only legitimate children could inherit their fathers' estates. In the United States, in the early 1970s, a series of Supreme Court decisions abolished most, if not all, of the common-law disabilities of bastardy... Yes. Depends, basically on what's put on the birth certificate.

Laws vary by locale, so without knowing your locale we can't be specific. But yes a child born out of wedlock (meaning to a mother and father who are not married to each other) can still carry the father's name, can have rights of inheritance, etc. it doesn't matter whether either parent is married to someone else or not. The rules are generally the same.
However, when a child is born to a married couple, the husband is usually presumed to be the legal father. The bio father would have to go to court to challenge this.

Do not you think that the child is legitimated notwithstanding born out of wedlock if
1.The father signed PA
2.The father was adjudicated as father through court proceeding.
An unmarried father initiates a legitimation proceeding so that he and his non-marital child can enjoy the same legal relationship as that which exists between a father and a child whose parents were married to each other at the time of the child's birth. If the legitimation request is granted, thereafter, the father is entitled to seek custody and visitation of his non-marital child , he is obligated to provide financial support for the child, and his name will be added to the child's birth certificate if it does not already appear on it. Once granted, legitimation establishes the child as an heir of the father.
