We currently are finishing our 15 month lease at apartment complex. It is time for renewal.
I am reading over the new lease and It has a buy out agreement if we beack the next lease early. They want to charge me two months rent and I need to pay back any discounts they give me on the rent for the whole 12 months new lease. They want me to pay the diffrence of my new rent to the fair market value. Is this fair should I have to pay them back for discounts they give me that we agreed upon 15 months prior?
I rented the apartment July 2009 for 999.00 when I called that's what they said was the rent for this apartment. When I decided to take the apartment in 2009 and was signing the lease I noticed that on the lease it said 1300.00. So I asked the lady what was that. She told me that they were running promotions for the summer and the 999.00 was my rent and it was a discounted rent. I didn't know that.
Now that its time to renew I called the apartment complex to check what is the current rent for my apartment and they said it is 986.00. But they want to charge me 1005.00 to renew my rent. I am OK with this. It's a great place to live and don't want to move if I don't have to.
The only thing is the Buy out agreement! Do you think this is right for them to charge me if I break the lease for a discount they are or would be giving me? Should I fight to change this on the new Lease? And do I have to sign the BUYOUT agreement?
