View Full Version : What are my chances of regaing custody of my son from his fathers parents?

I have a similar situation, I had custody of my son until he was about 3,he is now 5, I gave up custody to his fathers parents, because of financial reasons, and for the fact I was a single mother trying to join the army, which you have to give up custody. It was permanet custody because of the same I did not no and end date. I am now in the army and married, and I would like to regain custody. Ive had problems with the grandparents for the last year and I have the feeling she will fight me for custody. My child's father is a drug addict doesn't have a job, and is in and out of jail. I am also now paying child support for my son. What are my chances of getting custody backk, and what is the steps needed to take in doing so. I am also currently deployed and will return July 2011, can I start the process now?

Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.

Frankly, we have no way of knowing what your chances are. Partly because you give us very little info to go on. ANY question about law NEEDS to include your general locale as laws vary by area.

Also we would need to know what the court order specified. We don't know how much you have been a part of your child's life.

Nor can we predict what a court will do. But you do face an uphill battle. If you had granted temporary guardianship that would have been better. I would STRONGLY advise consulting an attorney who can better advise you.
