View Full Version : Can I charge Sears with theft if they do not return my vacumn (unrepaired)?

I sent my vacumn if for the same problem 3 times. The third time was off warranty so they now want $180 to fix what they did not the first two times.
They refuse to return the vacumn (un-repaired) without another $50 charge. This is blackmail in my opinion.
Can I or should I take them to small claims court? What is your opinion?

In essence you have a good idea and you are probably justified but I don't think taking Sears to to small claims court is an option that you have without a lot of headache. I think you are better off and saving some money in the long run, if you just pay the 50.
