View Full Version : Child not allowed around girlfriend who now the fathers wife?

My children now oldest almost 19 and youngest at 12 on final decree stated that the father exercise visitation is predicated on same being exercised out of presence of girlfriend. Now the girlfriend will be my wife in 3 weeks. I know oldest child is an adult and loves being with new wife, but 12 year old wants to be around her too, do I need to have an attorney set up for chamnges to court or how do I get it changed. She is not a mother to them, only a friend. They both love being with her.

Let me ask this, who says the 12 yr old is not allowed around your fiancée? There should be no need to modify your visitation order because you are getting married.

Your ex could make an issue if you are leaving the child alone with your fiancee/wife during your visitation time. Other than that, it shouldn't be a problem.

I will assume you are the father, and the mother still does not want the 12 year old around her.

If that is the case you will have to go back to court to get the visitation modified

I believe there has to be a Court Order that the children CAN be around this specific person - only a Court Order can change a prior Court decision.
