View Full Version : How do I get my boyfriend to move out?

I rent a house from my parents. My boyfriend and I have been living together since October. We have 1 child together. We have been fighting constantly and it's starting to get physical. I've asked him to leave but he won't, he says he pays rent to. What are my options? I live in Arkansas.

Talk tio a real estate lawyer... give get them to give him his 30 day notice to leave... if he doesn't leave file for an eviction. Doesn't matter if he pays rent or not... without a written lease in effect, the Landlord to toss him out with 30 days notice.
Its worth a few bucks to make sure he's properly notified and served in accordance with your states laws. He has less legal standing to fight his eviction that way if he chooses to.
However... if he physically assults you (not just verbally argues)... the police can remove him from the residence immediately.

Do you have a lease with your parents? Did he sign the lease? If there is no lease, your parents can issue a termination of tenancy to him. If he refuses to vacate, then they have to go through the formal eviction process.
If there is a lease and you are signed but he isn't then you are his landlord and can evict on your own.
If you both signed a lease, then you have to wait until the lease is up and have your parents tell him they will not be renewing.

No, I did not sign lease nor has he. Initially we combined our money, big mistake. Now he just pays me a portion of the bills.

Then your parents have to evict him, you have no legal standing to do so.

Forget all that stuff about eviction. This is a domestic violence situation. Get a restraining order.

I would work it out with your parents first since it is their house, if he refuses then get a restraining order, the worst thing to do is instigate, keep your cool and he may eventually leave on his own.
