He do have his last name.
Please help, our mother was afraid of him, she never wanted to confront him.

It's us again we meant to ask if there is still time to sue for child support we never received, even if we are 28 years old.
Thanks

Who are you going to sue for child support? It was never your mother's responsibility to pay it and it appears she never attempted to collect it from your father.
Was paternity established by the Court or did your mother simply SAY that this man was your father?
No, you are not entitled to anything from his estate if he did not know he was your father.
Is there recognized paternity - DNA test, something?

We are hoping we can sue our father's estate, our mother never attempted to collect he was a very dominant with her and will always put her down, she was afraid of him, he would tell her that if she would to take him to court he will take us away. He always recognized us as daughters he was always in our baptisms, first communions, and we have his last name.
He was around our lives he would always come to visit, the Probate Attorney's for the wife send us some documents that indicated if we wanted to contest the trust, or something like that. I think it was just paperwork to finalize the probate.
He did know he was our father, he always talked about leaving us something for our future, but he died
Suddenly, we know he wasn't prepared to die so soon. He was never sick he had stroke and died in 2 days. Yes we have letters from him, cards, pictures with him when we were growing up.
We hope this answers your questions.
Thank you
Mary Jo

Since you have letters, etc from your father I would suggest that you contact an attorney to pursue your inheritance rights and not your back child support. If you have any half brothers or sisters you could have a DNA testing to prove you are his progeny in court. It would be up to the Probate Judge to award you any money from his estate. Plus you do have his last name.
Would suggest you two seek an attorney as soon as possible to possibly pursue your inheritance.

You have no action for "back" child support because there is no "back" support, no Order ever having been issued.
You DO have a claim to the estate if everything you have said is true - and I'm assuming that it is.
You need to take the paperwork you received to an Attorney for his/her review and advice on how to proceed.

Did you bother reading the responses to the OP? There is no support issue since the mother never filed for support.
