Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.
There is not much you can do. A court is not likely to grant a change if the legal father objects.
Is this the same when it comes to a father wanting his child to have his last name if the mother never gave the child the fathers last name to begin with?

It depends on the marital status and some other issues

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.
Is there a legal father that will object to the change? If not, the situation is different.

Sorry! Yeah no, the situation with my husband is that the girl ran away to a different state and had their son and didn't put him on the birth certificate or give their son my husbands last name. She is now married with a new last name and refuses to change their son's last name to my husbands because her father doesn't and can't have any sons and there is no one to take on the family name... or that's her excuse. I don't feel that's right at all since her father isn't my stepsons father and doesn't provide for him.
