How can I get a trial date or file for dismissal or court ordered mediation? I had a lien placed upon my property by a builder that never completed the work (and, as a result, did not receive complete payment); he perfected the lien by filing a lawsuit, to which we had a lawyer file a motion to dismiss and a counter claim. Since that time nothing has happened. We had the state and local building code officials inspect our home; they noted several items that they ordered the builder to correct. He made a half-hearted effort to correct a couple things, but has since allowed his builder's license to lapse and stopped all communication with myself, our insurance company, and the building officials. Unfortunately we are still in a construction loan because of the lien. What can I do? I feel confident that, if given to opportunity, I can prove that I am indeed the injured party and that his lien was unjustified, but I cannot find a way to get a court date or court ordered mediation... so I am stuck until he sees fit to take some action?? Going on two years now... Had to get rid of our attorney after he wanted $15,000 to take any further action.

Unfortunately you started with an Attorney and I think it will be impossible to proceed without one. You can always advise the Court that you have discharged your Attorney - in my area an Attorney has to notify the Court if he/she walks away in the middle of a case - and you will be representing yourself but I am not certain you are familiar enough with the Law to effectively represent yourself.
