I have a friend that was evicted from a Section 8 subsidized property in Pennsylvania. The tenant was not dealing, but did have possession of a small amount of crack. She was a tenant for over 15 years with no problems. I have read most of the laws for this subject and about the only defense that can be used is the fact that they DO NOT HAVE TO evict this tenant, that it is up to their discretion. Are there any other defenses I might have missed. I do understand there are bad tenants in this world, this one really is not. Any suggestions folks?

Simple... there are waiting lists for Section 8 housing... Its not hard to avoid breaking the law... particularly where drugs are concerned. You don't accidentally have possession of crack, and no amount is "medicinal"

Sorry to say but there are plenty of poor on the waiting list who don't abuse drugs... and tax dollars should NOT subsidize drug users which Section 8 housing is doing. Got money for drugs... then you got money to pay market rate rent.

Sorry, I have no sympathy for those who don't play by the rules they agreed to in order to get that voucher. And the Rules are rules.. and there for a VERY good reason.
