I live in alberta, I am a 21 year old full time student and have a one year old daughter with my ex. We still are residing together due to my financial situation, and his agreement was to let me stay there until I finished which is in a little over 8 weeks.Suddenly, because I as well have been having my own(meeting with friends once a week) he has suddenly said that he wants me out asap. I live in alberta, I have no family here for support and no income, I have just applied for subsidized housing and am waiting for their response. Throughout or relationship he has been unfaithful and abusive. I need to know what my rights are as the mother of his child. Also, he pays for the rent and I pay for the bills, the bills are all in my name an come to our address. The lease is not in my name, however I am a tenant. He has agreed to pay child support but that doesn't start till I am moved out of his residency. HELP!! What do I do?

If you are not on the lease, you are a roommate and can be evicted by the leaseholder. However, if the utilities are all in your name, you might be able to make a case of being a co-tenant.

He will have to give you notice that he is terminating your tenancy. Generally this requires a 30 day notice. If you refuse to vacate he has to go through the courts to evict you. This will mean a hearing. This is where you can make the case of being a co-tenant.
