View Full Version : Will I get a court date with out being served

I have not been served my papers of a temporary custody from my ex. But I DID turn her over to not be charged with interfearing. I do not have a lawyer so I am working on my own. I have filed a response and a motion for a court date, but have gotten nothing. 2 questions. 1 howlong does the judge have to set a court date and 2 could my not being served be interfearing with why I haven't gotten a date yet?

Which party are you in this? Im assuming defendant because your asking about being served. And it was with that service that the court date would have been on there. How did you respond if you received nothing?

Yes defendant. We were working with a lawyer who got non sertafied copies of it to show us she wasent lying about the order. But the dates are blank and no sig cause we haven't excepted service yet. I am asking for my husband. His ex lied to the court and got a temp custody order for a child we have had for 2 years. But the judge signed the order without hearing our side or seeing the pre existing custody order we have.

In Fulton County GA, ( where I have filed) you get your court date the day you file the paper work, and then they send out notices in the next couple weeks.
