Help I received papers for a civil matter on a cc that is over four years old and they threatened to garnish my bank account I filed I answered the case and told them
What do I do now? The lady at the court told me that I will not have a court date that I would hear from the attorney that filed this in the court so what do I do now? Do I send a letter to the bank tellign them that my account only gets ssi disability in which that's all that goes into the account someone please help me in what to do next in this matter I'm afraid but this is what I sent to the courts and had filed and also sent it ceritified to the attorneys office to:
Notice of Intent to Defend
I cannot officially respond to your claim until validation is made for the alleged debt. I am officially requesting validation of your claim, to include:
- A copy of the original application with my signature for this alleged debt
- How much was this debt purchased for?
- Provide a fully itemized statement for the amount you are asking which clearly details how this amount over the amount that was paid for this debt was calculated, including the interest rate being charged. Confirm that this rate falls within state usury limits
This letter has been mailed via Certified Mail with Return Receipt. Receipt of this letter is being officially time stamped.
I am informing you that you must communicate me with via written correspondence only and now that you know how to communicate with me you must refrain from contacting any of my neighbors, friends, relatives or employees in an attempt to collect my debt. If you violate my request, I can threaten to sue you for an infraction of the FDCPA (Fair Debt Collection Practices Act) which allows $1,000 for each violation
