View Full Version : I-140 rejected because of non IT major in School

I have a undergraduate degree in Economics (with a minor in Computer Information Sciences) and a Masters in Political science.
I have been employed by a IT company for the last three years in a row for SAS (Statistical Analysis Software).
Recently my labor was approved by the DOL. However, my I-140 got rejected. My attorney says, its because I am working in an IT company , but have a degree in Pol. Science and Economics.
I told him (attorney) that SAS has to do with Stats and not only programming. I have graduate assistantships and references that says that I was involved in research using SAS. Moreover, I have programming as well as statistics/Econometrics courses, which proves that I can be SAS programmer.

What is your question? The rejection notice should state the reason(s) for the rejection as well as the appeal process which you must follow.

If your Attorney has reviewed all of your papers I would say he/she is correct; however, you can always consult with a second Attorney.

No appeal process is 24 months long and, we will will be dead after 22nd December 2010, therefore its not an option. I am going for a refile.
However, my question is, what changes does he needs to make to make so that TSC does not rejects again.
