I have a six year old son with an ex who resides in MD. I reside in VA, therefore the case with DCSE is in Virginia. My ex and I lived together and I were engaged when I got pregnant. Although we had been together for 3 years and lived together for 1, I left him when I was 6 months pregnant because he became physically abusive towards me when I turned 3 months pregnant (know that NOT ONCE during the three years together had he EVER even raised his voice in our home or even showed an angry streak! :-( ). Long story short, by the time my son was 8 months old, I had to put in effect a protective order against him because he hit me and hit the baby whom I was holding at the time. He did 3 months, plead guilty, etc... With the protective order came a child support order. He has not paid one penny since March of last year (and that last payment for 1500 he actually bounced the check on child support).

As I stated previously, he resides in MD and works in MD, but gets paid under the table. I told this to DCSE in VA AND gave them his contact info and location of employer, but when they tried to serve him there, they were told he only stops by and hangs out there, doesn't actually work there. He is ordered to pay 724.00 a month and now owes $32,000.00 dollars in arrearages. I have requested he be locked up, license suspended, etc... but they don't do anything... WHAT CAN I DO to get the interstate folks (MD/VA) to actually bring him back to court in VA, if possible? Does anyone know of a good lawyer in VA who won't totally break my pockets?

Generally DCSE has responsibility for collecting child support for families receiving public assistance, and also, upon application for non-public assistance families.In almost all states, services are available to Non-public assistance parents by the payment of a non-refundable $20 fee. If you are representing yourself, and you are not on public assistance, applying to the child support agency in your county for assistance is an excellent method of obtaining legal representation at minimal costHave you ever filed that application?Thus collecting child support payments will be their obligation.

Well, that is the problem I guess (which I don't believe I should have to be receiving gov't assistance in order to get legal stuff taken care of). I have never received government assistance with my child. I have busted my behind and have worked two jobs in the past to get us to the point where we are at now. *sigh* It is hard, but because I am not in poverty level, earning around 50k a year, I don't qualify for most anything anyway. I have a case with VA Division of Child Support enforcement, but they say that because it is an interstate case (filed and put into effect in VA, but NCP resides in MD) that VA calls them for updates, but MD always has 30 days to respond and on and on and here I am years later and nothing still being done. I need to get a lawyer own my own for this is going to continue to drag on and my child and I need the help. I pay 740.00 a month in daycare.

Enforce your support order in any state by simply registering the order in the state where you wish to enforce it and requesting enforcement. Income withholding orders can be sent to employees in any state without registering the order in that state. Amounts collected in other states will be subtracted from the amount due on the order in the issuing state.
If the mighty DCSE can do nothing what can a lawyer do?
If he works "under the table" DCSE cannot garnish anything.
Another question is that you are able to put lien upon some of his real estates,properties , etc.
