View Full Version : What Happens In Florida If You Get A 3 Day Notice To Vacate Your Home

So here's the thing. I'm renting and my landlord just gave me a 3-day eviction notice. We have been paying the rent every single month for the 5years that my family and I have been living here. He never fixes anything and we only see him when the rent is due and now he comes out of no where with this 3 day eviction notice. He's trying to say we haven't been paying rent when the truth is we hae NEVER missed a payment. I think he just wants to get us out faster. He doesn't do anything by the rules. Can you please give my some advice as to what I should do? Who I should contact?

If you don't leave in three days he will (probably) file eviction papers. There will be a formal hearing, you will present your proof that you do not owe rent and he will attempt to prove that you do.
The Court will then decide.

First, what he gave you was a vacate notice, not an eviction notice. It's the first step in the eviction process. You have 3 business days to pay what you owe or vacate the premises. If you do neither, he then goes to court for an eviction order. This will involve a hearing.
Now, if you are up to date in your rent, then simply forward him proof that you are paid up. If he denies that proof, then you present it to the judge at the hearing.
The fact that you are living there 5 years with an excellent payment record has NO bearing here. The fact that he has not made necessary repairs would have a bearing only if you had followed certain procedures to report this.
All the really matters is that you have paid what you owe. So the question, which you didn't make clear, is did you miss the due date for August or are you paid up through August?

Move. You're on a month to month tenancy in the first place - which means he can have you out in a month EVEN if he doesn't go through with this stupid eviction. Screw him.
